A BILL to amend article eight, chapter seven of the code of West
Virginia, one thousand nine hundred thirty-one, as amended,
by adding thereto a new section, designated section
thirteen, relating to providing that the agency that the
arresting officer represents shall be responsible to the
county for all costs associated with the incarceration; and
that Class III and Class IV municipalities shall be exempt
from this requirement.
Be it enacted by the Legislature of West Virginia:
That article eight, chapter seven of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section
thirteen, to read as follows:
ARTICLE 8. JAIL AND JAILER.
§7-8-13. Costs of incarceration.
When an arrest is made, the agency that the arresting
officer represents shall be responsible to the county for all
costs associated with the incarceration: Provided, That Class
III and Class IV municipalities shall be exempt from this
requirement.
NOTE: The purpose of this bill is to provide that the
agency that the arresting officer represents shall be responsible
to the county for all the costs associated with the
incarceration.
